Terms and Conditions for Contemporary Fence Panels

1. Definitions

1.1. “Buyer” refers to the individual or entity that agrees to purchase products (“Goods”) from Contemporary Fence Panels (“Seller”).

1.2. “Conditions” encompass the terms and conditions outlined in this document, along with any special terms and conditions agreed upon in writing by the Seller.

1.3. “Contract” signifies the agreement for the supply of Goods, governed by these Conditions.

1.4. “Delivery Date” is the date when the Goods are expected to be delivered, as specified by the Seller.

1.5. “Goods” are the items that the Buyer agrees to purchase from the Seller.

1.6. “Price” denotes the cost of the Goods, including charges for carriage and packing, but excluding insurance, VAT, and any additional charges as quoted by the Seller or as applicable under these Conditions.

1.7. “Seller” refers to Contemporary Fence Panels, located at The Fencing & Firewood Factory, Peel Street, Blackburn, BB2 2QF.

2. Conditions Applicable

2.1. These Conditions shall apply exclusively to all Contracts for the sale of Goods by the Seller to the Buyer, superseding any other terms or conditions proposed by the Buyer.

2.2. Orders for Goods are considered offers by the Buyer to purchase under these Conditions.

2.3. Acceptance of the Goods is conclusive evidence of the Buyer’s acceptance of these Conditions.

2.4. Variations to these Conditions are only valid if agreed upon in writing by the Seller.

2.5. Promotional materials are intended for illustrative purposes only and do not form part of the Contract.

2.6. Seller’s advice is provided without liability; reliance upon it is at the Buyer’s own risk.

2.7. These Conditions, along with any referenced documents, constitute the entire agreement between the parties.

3. Price and Payment

3.1. The Price includes VAT and is based on the Seller’s quoted rates.

3.2. Account customers must pay within 28 days of invoicing, subject to the Seller’s right to demand prepayment.

3.3. Overdue payments accrue interest at 5% above the National Westminster Bank’s base rate.

3.4. The Seller may modify credit terms at its discretion.

3.5. Non-payment may result in immediate demand for all outstanding balances.

3.6. Payment must be prompt, regardless of any disputes or delays.

3.7. Quotations are subject to change based on material and transport costs.

3.8. The Seller may adjust Prices to reflect cost increases or errors on the website.

3.9. Quotations are valid for 30 days unless withdrawn earlier.

4. The Goods

4.1. Variations in Goods’ appearance and quality are to be expected.

4.2. The Buyer should verify the suitability of Goods before purchase.

4.3. Most products comply with recognised certification schemes.

4.4. Product specifications are subject to change without notice.

4.5. Changes may be made to Goods to meet safety or legal standards.

5. Quality of Goods

5.1. The Seller guarantees that Goods will match their description upon delivery.

5.2. Claims for non-compliance must be made within 72 hours of delivery.

5.3. The warranty does not cover misuse, unauthorised alterations, or normal wear and tear.

5.4. The Seller’s liability for defective Goods is limited to repair, replacement, or refund.

5.5. Repaired or replaced Goods are also subject to these Conditions.

6. Buyer’s Obligations

6.1. The Buyer must provide accurate specifications and cooperate fully with the Seller.

6.2. Buyer Default may result in suspended Contract performance and additional costs.

7. Warranties and Liability

7.1. The Seller is not liable for indirect losses or damages.

7.2. Claims are void if materials are incorporated into other products.

7.3. Liability for defective Goods is limited to the Price, except in cases of negligence causing injury or death.

7.4. Implied warranties regarding Goods’ quality or fitness for purpose are excluded.

7.5. Liability for fraud or fraudulent misrepresentation remains unaffected.

8. Delivery

8.1. Delivery dates are estimates and not guaranteed.

8.2. Delivery includes kerbside drop-off unless otherwise arranged.

8.3. The Buyer is responsible for ensuring timely and cost-free delivery.

8.4. Unattended deliveries are at the Buyer’s risk.

8.5. International deliveries may incur additional duties and taxes.

8.6. Off-road deliveries are the Buyer’s responsibility.

8.7. Deliveries outside normal hours may incur extra charges.

8.8. Failure to accept delivery may result in storage charges or additional costs.

9. Acceptance

9.1. The Buyer must inspect Goods upon delivery for accuracy and quality.

9.2. Goods are considered accepted after 72 hours from delivery.

9.3. Discrepancies in quantity are acceptable within a 5% margin.

10.Cancellation

10.1. Cancellations are subject to Seller’s discretion and may incur charges.

10.2. Special order or personalised Goods cannot be canceled once processed.

10.3. Refunds are contingent upon the return and inspection of Goods.

11. Title and Risk

11.1. Risk transfers to the Buyer upon collection or delivery.

11.2. Ownership of Goods remains with the Seller until full payment is received.

11.3. The Buyer must store Goods separately and maintain them as the Seller’s property until ownership passes.

11.4. The Seller may reclaim Goods if the Buyer defaults on payment.

11.5. The Buyer cannot use the Goods as security for debts until full payment is made.By purchasing from Contemporary Fence Panels, the Buyer agrees to adhere to these Terms and Conditions.
